These terms govern the use of Thrustify, operated by Root Alpha UG (haftungsbeschränkt). They address merchants who use Thrustify to collect and display reviews, and people who write reviews.
We provide software with which merchants invite customers to review after an order, moderate incoming reviews, respond publicly and display them on their own website. We owe availability of the platform — not a commercial outcome, a review count or a particular rating.
We check that published reviews come from consumers who actually bought the product or service. To that end a review can technically only be submitted through an invitation bound to a real order and usable once; historical reviews imported from other platforms are labelled as such and only accepted when they carry an order or customer reference; and every published review receives a checksum so later edits are provable.
Merchants can neither buy nor delete reviews, nor publish them selectively. Positive and negative reviews go through the same checks and are displayed under the same rules. A review is removed only if it breaches section 4 or if a court or authority orders it.

Merchants warrant that invitations go only to people who actually ordered and that they hold the required data-protection basis. Sending invitations to purchased or third-party address lists is prohibited and entitles us to terminate without notice.
Fees follow the plan chosen at contract conclusion. Unless agreed otherwise, contracts run monthly and can be cancelled at the end of the billing period.
We are liable without limitation for intent and gross negligence, under the Product Liability Act, and for injury to life, body or health. For ordinary negligence we are liable only for breach of a material contractual duty, limited to the foreseeable damage typical of this type of contract.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the contracting party is a business, the place of jurisdiction is our registered office.
